Legal presumption of employment

The legal presumption of employment is a statutory provision being introduced by the VBAR law that means a self-employed professional with an hourly rate below a certain threshold (approximately €32.24 in 2025) can invoke the status of employee. The client must then demonstrate that there is no employment agreement. The legal presumption does not work automatically but must be invoked by the self-employed professional themselves, for example in a dispute or through the courts. It protects self-employed professionals with low rates against bogus self-employment.
